​​1. STORE POLICIES (DELIVERY, RETURNS, & CANCELLATIONS)

Welcome to Obsidian Boxworks! We take pride in our items, whether they are unique, bespoke pieces tailored specifically to you or from our ready-to-ship collections. Please read these policies carefully before placing your order.

1.1 Ordering and Customisation (For Bespoke Items)

  • Accuracy: It is your responsibility to ensure that all customisation details (including spelling, dimensions, colours, and specific requests) are 100% correct at the time of ordering.

  • Proofs (If applicable): If we provide a digital proof of your design, production will only begin once you have formally approved it in writing.

  • Variations: As our bespoke items are handmade and hand-painted, slight variations in colour, texture, patina, or finish may occur. These are natural characteristics of custom artisan work and are not considered faults.

1.2 Cancellations

We begin processing orders quickly to ensure timely delivery.

  • Bespoke/Custom Orders: You may cancel your custom order for a full refund within 24 hours of placing it, provided physical production has not yet begun. Once materials have been cast, cut, or the customisation process has started, we can no longer accept cancellations.

  • Premade/Ready-to-Ship Orders: You can cancel these orders at any time before they are dispatched for a full refund.

1.3 Returns and Refunds

Our return policy depends on whether you purchased a custom-made item or a premade item.

A. Bespoke and Personalised Items Under the Consumer Contracts Regulations 2013, bespoke and personalised goods are legally exempt from the standard 14-day "cooling-off" period.

  • Because your item has been made specifically for you, we cannot accept returns, exchanges, or offer refunds if you simply change your mind or if you provided incorrect customisation details.

B. Premade and Ready-to-Ship Items For items that are not custom-made, standard UK consumer rights apply.

  • Change of Mind: You have the right to cancel and return your premade order within 14 days of receiving the goods. You then have a further 14 days to return the item to us.

  • Items must be returned in their original, unused condition and packaging.

  • Return Postage: The buyer is responsible for the cost of return postage for "change of mind" returns. We recommend using a tracked service, as we cannot be held responsible for items lost in transit.

C. Faulty or Damaged Items (Applies to ALL items) Your rights under the Consumer Rights Act 2015 are fully protected. If any item (bespoke or premade) arrives damaged, faulty, or is significantly not as described, you are entirely entitled to a repair, replacement, or refund.

  • Please contact us within 30 days of receiving a faulty item.

  • We will require photographic evidence of the damage or fault to process your claim.

  • If a return is necessary due to a fault, we will cover the cost of standard return postage.

1.4 Shipping and Delivery

  • Lead Times: * Bespoke Items: Made to order, processing takes 1–3 weeks before dispatch.

    • Premade Items: Dispatched within 1–3 working days.

  • Delivery: Once dispatched, standard UK delivery takes approximately 1-3 days.  We are not responsible for delays caused by postal strikes or courier issues, though we will do everything we can to help locate delayed parcels.

  • Customs/Import Taxes: For international orders, buyers are responsible for any customs and import taxes that may apply.

2. PRIVACY POLICY

To fulfil your order, you must provide us with certain information, which includes:

  • Shipping Information: Your postal address for delivery.

  • Order Details: Information about the products you are ordering, including any customisation requests.

  • Payment Information: We do not see or store your full credit card details. Payments are processed securely through third-party payment gateways.

2.2 How We Use Your Information

We rely on a number of legal bases to collect, use, and share your information, including:

  • To Fulfill Orders: We use your information to provide our services, such as processing your order, settling disputes, or providing customer support.

  • To Communicate with You: We will use your email to send order confirmations, dispatch notices, and respond to your direct inquiries.

  • For Legal Compliance: We may collect, use, retain, and share your information if necessary to comply with legal or tax obligations in the UK (such as retaining purchase records for HMRC).

2.3 Information Sharing and Disclosure

We share your personal information for very limited reasons and in limited circumstances:

  • Service Providers: We engage trusted third parties to perform functions and provide services, such as delivery companies (e.g., Royal Mail, couriers). We share your information only to the extent necessary to perform these services.

  • Business Transfers: If we sell or merge our business, we may disclose your information as part of that transaction, only to the extent permitted by law.

  • Compliance with Laws: We may share your information if we have a good faith belief that it is reasonably necessary to respond to legal processes, enforce our agreements, prevent fraud, or protect the rights and safety of our customers.

2.4 Data Retention

We retain your personal information only for as long as necessary to provide you with our services. We generally keep your order data for 7 years to comply with UK tax law.

2.5 Your Rights (UK GDPR)

If you reside in the UK or the EU, you have specific rights regarding your personal information, including the right to access, change, restrict, or delete your data, and the right to object to processing. You also have the right to lodge a complaint with the Information Commissioner’s Office (ICO).

  • Copyright: All content on this store (photography, logos, text) is the property of Obsidian Boxworks and may not be reproduced without permission.

4.2 Limitation of Liability

To the maximum extent permitted by UK law, Obsidian Boxworks shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of our service or products. Our maximum liability to you will not exceed the purchase price of the specific item.
